Welcome to The List.
These Terms of Service (“Terms”) govern your access to and use of the website, directory, accounts, content, recommendations, events, communications, and other products and services offered by The List Wellness, LLC (“The List,” “we,” “us,” or “our”), including through thelistwellness.com and related platforms (collectively, the “Services”).
By accessing or using the Services, creating an account, submitting information, or purchasing a product, membership, ticket, or other paid offering from The List, you agree to these Terms.
If you do not agree to these Terms, please do not use the Services.
The List is a curated discovery, referral, community, and editorial platform designed to help women and families find providers, experts, businesses, services, resources, and recommendations.
Our Services may include, among other things:
The features available through The List may change over time.
The List does not provide medical, psychiatric, psychological, nutritional, therapeutic, legal, financial, or other professional care.
Nothing available through The List should be considered a diagnosis, treatment plan, prescription, medical advice, or substitute for care from a qualified professional.
Information provided through the directory, Ask The List, editorial content, email, social media, events, or any other part of the Services is intended for general informational and discovery purposes only.
You are responsible for making your own healthcare and professional-service decisions in consultation with appropriately qualified professionals.
If you believe you or another person may be experiencing a medical or mental health emergency, contact 911, 988, or an appropriate emergency service rather than relying on The List.
Providers, practitioners, experts, businesses, and other professionals appearing on The List (“Providers”) are independent third parties.
They are not employees, agents, partners, representatives, joint venturers, or contractors of The List solely because they appear on the platform or participate in The List.
Any services you receive from a Provider are provided directly by that Provider and are governed by the terms, policies, professional obligations, and agreements between you and that Provider.
The List is not a party to that relationship and is not responsible for a Provider’s:
Any dispute regarding services received from a Provider should generally be addressed directly with that Provider.
Curation is an important part of The List.
We may speak with Providers, review information they submit, consider professional experience, learn about their practices, and use our own editorial judgment when deciding whom to feature or recommend.
However, inclusion on The List is not a certification, warranty, guarantee, or endorsement of any particular result.
While we make reasonable efforts to maintain high-quality information, The List does not guarantee that information provided by or about a Provider is complete, accurate, or continuously up to date.
Licensure, credentials, certifications, insurance participation, availability, pricing, services, business ownership, locations, and other Provider information may change.
Before engaging a Provider, you should independently confirm any information important to your decision, including licensure, credentials, insurance coverage, availability, fees, and whether the Provider is appropriate for your specific needs.
Some Providers and businesses featured on The List pay membership, listing, participation, advertising, sponsorship, event, or other fees to The List.
Payment does not guarantee a particular ranking, recommendation, referral, amount of exposure, number of leads, client relationship, or business outcome.
We retain editorial discretion over whom we feature, recommend, remove, or decline to include.
Where appropriate, sponsored, affiliate, or paid relationships may also be separately identified.
Ask The List and similar recommendation features allow users to share information about what they are looking for so that The List can suggest Providers or resources that may be relevant.
Recommendations may be based on factors including:
Recommendations are intended to help narrow your search. They are not medical advice and do not guarantee that a particular Provider will be available, accept your insurance, be appropriate for your needs, or ultimately feel like the right fit.
Recommendations may not represent every Provider or option available in your area.
You are responsible for evaluating any Provider before beginning services.
Certain features may allow you to create an account, save Providers, create a personalized list, or access other account-based functionality.
You are responsible for:
Saved profiles and account features are provided for convenience. We do not guarantee that saved content, Provider profiles, or particular platform features will remain available indefinitely.
We may suspend or terminate accounts that violate these Terms or misuse the Services.
You may choose to provide information when using features such as Ask The List, account registration, newsletter sign-up, Provider contact features, event registration, surveys, forms, or other Services.
You agree that information you submit will be accurate to the best of your knowledge and that you will not intentionally submit false, misleading, unlawful, or abusive content.
Our collection, use, storage, and disclosure of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Please do not use The List to submit information that you do not have the right to provide.
When you provide an email address or other contact information, we may send communications necessary to provide the Services you requested, including account, recommendation, purchase, registration, or service-related messages.
If you separately subscribe to newsletters, marketing communications, or promotional emails, you may unsubscribe from those communications using the unsubscribe mechanism provided.
Unsubscribing from marketing communications may not prevent us from sending transactional or service-related communications that are necessary to operate an account or fulfill a request.
Some Services may be offered through paid memberships or subscriptions.
Before you purchase a recurring subscription, applicable pricing, billing frequency, and material subscription terms will be presented to you at checkout.
By purchasing a recurring subscription, you authorize the applicable recurring charges until the subscription is cancelled.

Instructions for cancelling will be made reasonably available through the applicable account, billing platform, or by contacting The List.
Specific membership programs may also be subject to additional terms disclosed at enrollment. If program-specific terms conflict with these Terms, the program-specific terms will control for that program.
The List may offer event tickets, workshops, programs, products, memberships, or other paid Services.
Prices and material purchase terms will be disclosed before purchase.
Certain purchases may be subject to additional cancellation, refund, transfer, event, or participation policies presented at checkout or registration.
Events may take place at third-party venues and may involve third-party vendors, speakers, Providers, sponsors, or partners. Those third parties remain responsible for their own products, services, premises, and conduct.
Event schedules, participants, programming, venues, or other details may change when reasonably necessary.
Unless otherwise stated at the time of purchase, applicable refund and cancellation terms are governed by The List’s Refund & Cancellation Policy, which is incorporated into these Terms by reference.
If a different refund or cancellation policy is specifically disclosed for an event, program, membership, promotion, or other offering, that more specific policy will apply.
Nothing in these Terms limits any refund or other remedy that you are legally entitled to receive.
From time to time, The List may feature products, brands, offers, discount codes, gifted products, sponsors, or affiliate links.
If you purchase something through certain links, The List may receive a commission or other compensation at no additional cost to you.
The inclusion of a product or brand reflects editorial, commercial, or partnership considerations depending on the context, and does not constitute a guarantee regarding the product’s quality, safety, effectiveness, or suitability for you.
Product information and claims made by third-party brands are the responsibility of those third parties.
The Services may contain links to Provider websites, scheduling platforms, social media accounts, payment processors, shops, event platforms, or other third-party websites and services.
These third parties operate independently from The List.
We do not control and are not responsible for their:
Your use of a third-party service is subject to that third party’s own terms and policies.
You may not use the Services to:
We may restrict, suspend, or terminate access if we reasonably believe these Terms have been violated or the Services are being misused.
The List and its original content, including its branding, logos, design, directory structure, written profiles, Founder’s Notes, recommendations, graphics, guides, articles, newsletters, photographs owned by The List, and other original editorial materials, are owned by or licensed to The List Wellness, LLC and are protected by applicable intellectual-property laws.
You may use our publicly available content for ordinary personal, noncommercial use.
You may not reproduce, republish, distribute, modify, sell, scrape, create derivative commercial products from, or otherwise commercially exploit our protected content without prior written permission.
Third-party trademarks, photographs, Provider materials, and other third-party content remain the property of their respective owners.
If you voluntarily provide feedback, suggestions, ideas, testimonials, or other non-confidential input regarding The List, you permit us to use that feedback to operate and improve the Services without an obligation to compensate you.
We will obtain any permissions required by law before publicly using your name, likeness, testimonial, or other personal endorsement in promotional materials.
The List exists to make finding support easier. We cannot guarantee what happens after an introduction or recommendation.
We do not guarantee:
Your decisions and interactions with Providers remain your responsibility.
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
We make no warranty that the Services will be uninterrupted, error-free, completely accurate, secure, or continuously available.
We may add, modify, remove, suspend, or discontinue features or content as The List evolves.
Nothing in this section excludes warranties or rights that cannot legally be excluded.
To the fullest extent permitted by applicable law, The List Wellness, LLC and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to:
To the fullest extent permitted by law, The List’s aggregate liability for claims arising from the Services will not exceed the greater of $100 or the amount you paid directly to The List for the specific consumer Service giving rise to the claim during the twelve months preceding the event giving rise to liability.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
To the extent permitted by law, you agree to indemnify and hold harmless The List Wellness, LLC and its owners, officers, employees, and representatives from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:
This obligation does not apply to claims caused by conduct of The List for which indemnification cannot legally be required.
We may suspend, restrict, or terminate your access to some or all of the Services if you:
Where appropriate, we may provide notice before termination, but we are not required to do so where immediate action is reasonably necessary.
Termination does not eliminate obligations or rights that accrued before termination.
The List will continue to evolve, and we may update these Terms periodically.
When we make material changes, we will update the “Last Updated” date and may provide additional notice where required by law or appropriate under the circumstances.
Changes will apply prospectively from their effective date.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles.
Except where applicable law provides otherwise, disputes arising from these Terms or the Services will be brought in a state or federal court with appropriate jurisdiction in Massachusetts.
Nothing in these Terms prevents either party from exercising rights or remedies that cannot legally be waived.
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and any additional terms presented for a specific Service, constitute the agreement between you and The List regarding your use of the applicable Services.
Provider members may also be subject to a separate Provider Membership Agreement. That agreement governs the relationship between The List and the Provider and is separate from these consumer Terms of Service.
